By accessing the Party with Mal LLC website or purchasing or booking services through Party with Mal, you agree to the following Terms & Conditions.
Services
Party with Mal provides custom event décor and event-related services, which may include luxury sleepovers, balloon décor, Bloom Bar rentals, window painting, hand-painted banners, custom event décor, rentals, and related services.
Availability, pricing, inclusions, delivery, setup, pickup, and other requirements vary by service.
Quotes & Pricing
Pricing displayed on our website or social media may represent starting prices and is subject to change.
Custom quotes may vary depending on event size, design, materials, location, setup requirements, delivery, customization, and other factors.
A quote does not guarantee availability until the booking requirements have been completed.
Booking & Payment
A retainer may be required to reserve an event date or begin custom work. Dates are not considered reserved until all required booking steps have been completed.
Payment schedules, retainers, cancellation policies, and other service-specific requirements will be provided during the booking process and/or in your client agreement.
Custom & Handmade Items
Many Party with Mal products are individually designed and handmade. Slight variations in colors, lettering, placement, materials, or appearance are natural characteristics of handmade work and are not considered defects.
Colors may also appear differently on screens than they do in person.
Inspiration Images
Clients are welcome to provide inspiration photos. Inspiration images are used to understand your preferred style, colors, or overall vision.
Party with Mal does not guarantee exact replicas of another artist’s or business’s work and may modify designs to create an original Party with Mal piece.
Balloons
Balloon appearance and longevity may be affected by temperature, sunlight, wind, weather, transportation, handling, and other environmental conditions.
Once balloon décor has been delivered or installed and accepted, Party with Mal cannot guarantee its condition after leaving the event location.
Rentals & Sleepover Equipment
Rental items remain the property of Party with Mal unless otherwise stated.
Clients are responsible for taking reasonable care of rental items while they are in their possession. Additional charges may apply for items that are lost, damaged, excessively soiled, or not returned as agreed.
Additional rental and sleepover requirements may be included in the client’s booking agreement.
Bloom Bars & Flowers
Because fresh flowers are natural products, varieties, shades, sizes, and availability may vary. When a particular flower is unavailable, Party with Mal may make reasonable substitutions while maintaining the overall color palette and style of the event.
Window Painting
Window artwork is temporary and may naturally change or deteriorate due to weather, cleaning, condensation, contact, or other environmental factors.
Removal services may be available separately unless specifically included in the client’s quote.
Outdoor Events & Weather
Outdoor décor is subject to weather conditions. Wind, rain, heat, cold, and other environmental factors may affect balloons, backdrops, signage, flowers, and other décor.
Party with Mal reserves the right to modify or decline an installation when conditions could create a safety concern or risk significant damage to equipment.
Cancellations & Rescheduling
Cancellation and rescheduling terms may vary depending on the service booked, materials already purchased, custom work completed, and proximity to the event.
The policies contained in a signed client agreement or booking confirmation will control when they differ from these general website terms.
Intellectual Property
Original designs, photographs, website content, branding, graphics, and other creative materials created by Party with Mal may not be reproduced, copied, sold, or used commercially without permission.
Purchasing a physical product does not transfer ownership of the underlying design or intellectual property rights.
Limitation of Liability
To the fullest extent permitted by applicable law, Party with Mal LLC will not be liable for indirect, incidental, or consequential damages arising from the use of our website, products, rentals, or services.
Nothing in these Terms is intended to waive rights or remedies that cannot legally be waived under applicable law.
Website Information
We make reasonable efforts to keep website information accurate and current. However, availability, pricing, product descriptions, photographs, and other information may change without notice.
Governing Law
These Terms & Conditions are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
